General Terms and Conditions
§ 1 Booking, Conclusion of Contract

These General Terms and Conditions apply to all services offered by AGT Bus- & Eventlogistik GmbH in the area of one-off transport orders (passenger transport / transfer services) and mobility services (booking of transport services, concept development, event logistics, etc.). These Terms do not apply to long-term contracts such as works transport or employee shuttle services.
Note: AGT Bus- & Eventlogistik GmbH provides transport services exclusively. It is not a tour operator within the meaning of § 651a of the German Civil Code (BGB). Where AGT Bus- & Eventlogistik GmbH arranges supplementary services at the customer's request (e.g., hotel accommodation, admission tickets), it acts solely as an intermediary on behalf of and for the account of the customer. These services are not part of the transport contract and are invoiced separately. They do not constitute package travel.
§ 1 Booking, Conclusion of Contract
1.1 The minimum age for unaccompanied participation in transport is 16 years. Passengers who have not yet reached the age of 18 at the start of transport and who travel without adult accompaniment require written consent from a parent or legal guardian.
1.2 Supervision of passengers, in particular children, minors, and persons requiring assistance, is not part of the services provided by AGT Bus- & Eventlogistik GmbH.
1.3 The booking is made by the person making the booking also on behalf of all other passengers included in the booking (hereinafter jointly also the "Customer" or "Passenger"). To do so, the person booking first submits a non-binding inquiry for the transport service via the booking form on the AGT Bus- & Eventlogistik GmbH website, by phone, or by email. AGT Bus- & Eventlogistik GmbH reviews the inquiry submitted and, where necessary, asks follow-up questions to determine the transport requirements.
1.4 AGT Bus- & Eventlogistik GmbH then informs the customer, based on the information provided, about the available vehicles, prices, and other services, and sends the customer a non-binding offer for the requested transport by email. All offers from AGT Bus- & Eventlogistik GmbH are subject to change and non-binding unless expressly marked as binding.
1.5 All offers and the transport prices listed therein do not include road, toll, and parking fees unless these are separately and expressly stated in the offer. Where not included in the offer, AGT Bus- & Eventlogistik GmbH will invoice these costs separately.
1.6 By placing the order, the person booking submits a binding offer to conclude a transport contract with AGT Bus- & Eventlogistik GmbH. The order may be placed by signing the offer, by email, or by sending an order form. The contract is only concluded upon receipt of the order confirmation from AGT Bus- & Eventlogistik GmbH by the person booking. The order confirmation must be in text form (email is sufficient).
1.7 The person booking is liable for all contractual obligations of participants for whom they made the booking, as if they were their own obligations, insofar as the person booking has assumed these obligations through an express and separate declaration.
§ 2 Additional Services
AGT Bus- & Eventlogistik GmbH generally provides only transport services. At the customer's express request, AGT Bus- & Eventlogistik GmbH may arrange supplementary services (e.g., hotel accommodation, admission tickets for amusement parks or other events). The arrangement of additional services is always separate from the transport contract. The transport service and the arranged additional service are not offered as a total package price. This does not constitute package travel within the meaning of § 651a BGB.
§ 3 Payment of the Transport Price
3.1 Payments may be made as follows: direct bank transfer (limit €50,000), bank transfer, PayPal (limit €1,000). Additional processing fees may apply for credit card payments depending on the customer's respective credit institution. These additional fees are to be borne by the customer.
3.2 After reviewing the order pursuant to clause 1.6, AGT Bus- & Eventlogistik GmbH sends the person booking an order confirmation and invoices the services included in the offer.
3.3 After conclusion of the contract and receipt of the invoice, a deposit of 20% of the total price is due within 14 days, unless the case in clause 3.4 applies. The remaining price is due 28 days before the start of the trip.
3.4 For bookings made within 28 days of the start of service, the entire transport price is due immediately.
3.5 Cleaning costs are not included in the prices offered. Costs for cleaning excessively soiled vehicles (e.g., defective/blocked toilets, vomit inside the vehicle) and for repairing self-inflicted damage are to be borne separately by the customer and will be invoiced after completion of transport.
3.6 AGT Bus- & Eventlogistik GmbH reserves the right to charge statutory default interest in the event of late payment, as well as to assert further damages resulting from default. The right to prove that no or substantially lower costs were incurred remains unaffected.
3.7 If due payments are not made, or not made in full, and remain unpaid even after a reminder with a grace period, AGT Bus- & Eventlogistik GmbH may withdraw from the respective contract, unless a significant defect attributable to AGT Bus- & Eventlogistik GmbH already exists at that time. In the event of withdrawal under the preceding sentence, AGT Bus- & Eventlogistik GmbH may claim withdrawal fees as compensation in accordance with clauses 10.3, 10.4, 10.5.
§ 4 Provision of Security (Deposit)
4.1 The person booking must inform AGT Bus- & Eventlogistik GmbH of the purpose of the transport (e.g., transport to sporting events, concerts, company outings, trade fairs, demonstrations, or comparable large events) as well as the number of passengers.
4.2 AGT Bus- & Eventlogistik GmbH is entitled to demand payment of a reasonable deposit as security against potential damages. The amount of the deposit depends in particular on the vehicle category and the order volume, and will already be communicated to the person booking in the offer. By accepting the offer, the person booking also commits to paying the deposit stated in the offer.
4.3 AGT Bus- & Eventlogistik GmbH may also assert the right to a security deposit after the contractual relationship has begun.
§ 5 Changes to Services
5.1 Before conclusion of the contract, AGT Bus- & Eventlogistik GmbH may amend the service descriptions in the offer at any time. Until receipt of the order confirmation, all offers from AGT Bus- & Eventlogistik GmbH remain subject to change and non-binding (see clause 1.4).
5.2 Changes or deviations in individual transport services after conclusion of the contract that are not brought about by AGT Bus- & Eventlogistik GmbH in bad faith are permissible, provided they are not significant and do not impair the overall character of the booked transport. Warranty claims remain unaffected, in particular where the changed services are defective.
5.3 AGT Bus- & Eventlogistik GmbH will inform the customer without delay of any change to a material transport service once it becomes aware of the reason for the change.
§ 6 Price Increases and Price Reductions
6.1 AGT Bus- & Eventlogistik GmbH reserves the right to change the transport price agreed at conclusion of the contract in accordance with the provisions below, provided more than four months lie between the customer's receipt of the booking confirmation and the agreed transport date.
6.2 A price adjustment is only permissible if and to the extent that the following cost components have changed since conclusion of the contract:
a) Fuel costs: change in net costs for diesel or fuel compared to the time of conclusion of the contract, measured by the federal average price according to the Federal Statistical Office;
b) Road usage fees and tolls: change in statutorily or officially set toll fees, road usage fees, or comparable charges for the agreed transport route;
c) Taxes and public levies: change in taxes or officially imposed levies charged on the transport service, insofar as these are not already covered under letter b).
6.3 The new transport price is calculated by taking into account the above-mentioned cost components in proportion to their respective share of the original transport price, adjusted proportionally according to the cost change that has occurred. The relevant reference date for calculating the cost change is the day the contract was concluded.
6.4 AGT Bus- & Eventlogistik GmbH is obliged to pass on cost reductions in the cost components listed in clause 6.2 to the customer according to the same standards as cost increases. A price reduction must be made to the same extent that a price increase would be permissible under this clause.
6.5 A price adjustment under this clause is excluded if the agreed transport date is less than 21 days after notification of the price adjustment.
6.6 AGT Bus- & Eventlogistik GmbH must inform the customer of a price adjustment without delay in text form. The notification must present the calculation of the new price in a comprehensible manner, stating the changed cost components.
6.7 In the event of a price increase of more than 5% of the agreed transport price (total price), the customer is entitled to withdraw from the contract free of charge. Withdrawal must be declared to AGT Bus- & Eventlogistik GmbH in text form (by email or letter) within 7 days of receipt of the notification of the price increase.
§ 7 Rebookings and Changes to Services by the Customer
7.1 There is no entitlement to a rebooking. Requested rebookings must be submitted by the customer to AGT Bus- & Eventlogistik GmbH in text form (e.g., by email).
7.2 Upon the customer's request, AGT Bus- & Eventlogistik GmbH may make a change to the booking ("Rebooking"). Rebookings include, for example, changes to the route, destination, place of departure, date and/or time, number of participants, vehicles, number of persons, additional services, and special requests.
7.3 After receiving the rebooking request, AGT Bus- & Eventlogistik GmbH will review whether and under what conditions a rebooking is possible. In the event that:
a) a rebooking is not possible, AGT Bus- & Eventlogistik GmbH will inform the customer of this fact;
b) a rebooking is possible, AGT Bus- & Eventlogistik GmbH will submit an offer to the customer for a contract amendment. The offer also includes any additional costs that may arise. The customer may accept the offer. Text form (e.g., by email) is sufficient for acceptance. A contract under the amended terms is only concluded upon acceptance of the offer.
7.4 If the customer accepts the offer for a contract amendment, AGT Bus- & Eventlogistik GmbH will issue a new invoice, a so-called "supplementary invoice." This supplementary invoice includes, in addition to the services, any additional costs incurred and, if applicable, a deposit pursuant to clause 4.
7.5 The invoice pursuant to clause 7.4 must be paid by the customer upon receipt. The payment deadlines set out in paragraphs 3.3 and 3.4 apply.
7.6 The customer remains free to withdraw from the contract under the conditions set out in § 10.
§ 8 Withdrawal, Cancellation of Transport
8.1 AGT Bus- & Eventlogistik GmbH may withdraw from the contract before the start of service if it is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances (Force Majeure).
8.2 Force majeure is any unforeseeable event outside of [AGT's control] that wholly or partly prevents AGT Bus- & Eventlogistik GmbH from fulfilling its obligations, including fire damage, floods, strikes and lawful lockouts, unexpected pandemics or epidemics, as well as operational disruptions or official orders not caused by its own fault. Supply difficulties and other service disruptions on the part of AGT Bus- & Eventlogistik GmbH's upstream suppliers are only considered force majeure if the supplier itself is prevented from providing its service by an event as described in clauses 8.1 and 8.2.
8.3 In this case, AGT Bus- & Eventlogistik GmbH must declare the withdrawal without delay after becoming aware of the reason for withdrawal. If AGT Bus- & Eventlogistik GmbH withdraws from the contract, it loses its claim to the agreed transport price.
§ 9 Termination by AGT Bus- & Eventlogistik GmbH
9.1 AGT Bus- & Eventlogistik GmbH may terminate the contract without notice if the performance of the booked service is persistently disrupted by the customer or other recipients of the transport service despite a corresponding warning from AGT Bus- & Eventlogistik GmbH. The same applies if the contracting party behaves in breach of contract to such an extent that immediate termination of the contract is justified.
9.2 AGT Bus- & Eventlogistik GmbH sees itself as a diverse and tolerant company that respects democratic core values and lives by a respectful, inclusive culture. An important reason within the meaning of clause 9.1 exists in particular if there is a well-founded and objectively comprehensible reason to believe that the client, its customers, or the content or events associated with the order contradict these corporate values. This includes in particular extremist, racist, discriminatory, or anti-democratic content and events — regardless of their political, religious, or ideological orientation.
9.3 In the case of clause 9.1, AGT Bus- & Eventlogistik GmbH retains its claim to the agreed transport price. However, AGT Bus- & Eventlogistik GmbH must offset the value of expenses saved as well as any benefits obtained from alternative use of services not utilized, including any reimbursements from service providers.
9.4 Additional costs arising from termination for the return transport and for handling the disruption are borne by the party causing the disruption.
§ 10 Withdrawal by the Customer
10.1 The customer may withdraw from the contract at any time before the start of transport ("start of transport/service"). Withdrawal must be declared to AGT Bus- & Eventlogistik GmbH in text form, e.g., by email.
10.2 If the customer withdraws before the start of transport, AGT Bus- & Eventlogistik GmbH loses its claim to the agreed price. Instead, AGT Bus- & Eventlogistik GmbH may demand reasonable compensation ("withdrawal fee"),
a) provided the withdrawal is not attributable to AGT Bus- & Eventlogistik GmbH, and
b) provided no extraordinary circumstances occur at or near the destination that significantly impair performance of the booked service and transport to the destination; circumstances are unavoidable and extraordinary if they are beyond AGT Bus- & Eventlogistik GmbH's control and their consequences could not have been avoided even if all reasonable precautions had been taken.
AGT Bus- & Eventlogistik GmbH may, in the event of withdrawal, demand the following flat-rate withdrawal fees. The withdrawal fees are determined according to the following percentages of the agreed total price, less the expected savings in expenses and less what AGT Bus- & Eventlogistik GmbH earns through alternative use of the services. The flat rates below also take into account the period between the declaration of withdrawal and the start of the trip/service. The withdrawal fees will be justified by AGT Bus- & Eventlogistik GmbH upon request.
The flat-rate claim to withdrawal fees is:
Up to the 45th day before the start of the trip/service: 15%
From the 44th to the 30th day before the start of the trip/service: 25%
From the 29th to the 15th day before the start of the trip/service: 50%
From the 14th to the 7th day before the start of the trip/service: 75%
From the 6th day before the start of the trip/service: 90%
or in the case of non-commencement of the trip or non-use of the service: the full agreed price.
10.4 The customer is free to prove that AGT Bus- & Eventlogistik GmbH incurred no damage or a lower amount of damage than the flat-rate compensation demanded. In that case, the customer only owes no compensation or the lower amount.
10.5 Should the withdrawal fees named in clause 10.3 not have been effectively agreed for legal or factual reasons in the event of withdrawal, AGT Bus- & Eventlogistik GmbH reserves the right to demand specific compensation instead of the withdrawal fees. The amount of the specific compensation is determined by the price of the services less the value of expenses saved by AGT Bus- & Eventlogistik GmbH, as well as less what AGT Bus- & Eventlogistik GmbH earns through alternative use of the services. The withdrawal fees will be justified by AGT Bus- & Eventlogistik GmbH upon request.
§ 11 Notice of Defects, Remedy, Reduction, Termination by the Customer
11.1 If the transport is not provided in accordance with the contract, the customer may notify AGT Bus- & Eventlogistik GmbH of the defect and demand remedy. AGT Bus- & Eventlogistik GmbH may refuse remedy if it is impossible or associated with disproportionate costs.
11.2 The customer may demand a reduction of the agreed price if services were not provided free of defects and the customer did not culpably fail to report the defect without delay.
11.3 Insofar as AGT Bus- & Eventlogistik GmbH is unable to provide a remedy due to a culpable failure to report the defect, neither reduction claims nor damage claims may be asserted with regard to the defective services.
11.4 If the booked service is significantly impaired by a service defect and AGT Bus- & Eventlogistik GmbH does not provide a remedy within a reasonable period, the customer may terminate the contract. Setting a deadline for remedy is not required if AGT Bus- & Eventlogistik GmbH refuses remedy or if immediate remedy is necessary.
11.5 If the contract is thereby terminated, the customer retains the right to return transport. In the event of termination under this § 11, the customer only owes AGT Bus- & Eventlogistik GmbH the portion of the agreed transport price attributable to the services already used (or still to be provided to complete the transport).
§ 12 Liability
12.1 The liability of AGT Bus- & Eventlogistik GmbH is governed by statutory provisions, unless otherwise specified in the following paragraphs.
12.2 AGT Bus- & Eventlogistik GmbH is liable without limitation:
a) for damages arising from injury to life, body, or health resulting from a negligent or intentional breach of duty by AGT Bus- & Eventlogistik GmbH, its legal representatives, or its vicarious agents;
b) for other damages resulting from an intentional or grossly negligent breach of duty by AGT Bus- & Eventlogistik GmbH, its legal representatives, or its vicarious agents;
c) for damages under the Product Liability Act;
d) to the extent AGT Bus- & Eventlogistik GmbH has assumed a guarantee for the quality of the transport service, to the extent of that guarantee.
12.3 In the event of a slightly negligent breach of material contractual obligations, AGT Bus- & Eventlogistik GmbH's liability for property and financial damages is limited to the foreseeable, typical damage at the time of conclusion of the contract. Material contractual obligations are those whose fulfillment enables the proper performance of the transport contract in the first place, and on whose compliance the customer may regularly rely. These include, in particular, the duty to transport passengers safely and in accordance with the contract, the duty to safely store luggage handed over for transport, and the duty to observe the agreed transport time.
12.4 For property and financial damages caused by slight negligence that do not result from a breach of material contractual obligations within the meaning of clause 12.3, AGT Bus- & Eventlogistik GmbH's liability is excluded. Clause 12.2 remains unaffected.
12.5 For property damage to items carried by a transported passenger (carried luggage, clothing, personal belongings), liability for slight negligence is limited to €1,000.00 per passenger and transport journey. For luggage checked in for transport in occasional coach services, liability for slight negligence is limited to €1,200.00 per piece of luggage. Sentences 1 and 2 do not apply to mobility aids.
12.6 The above limitations and exclusions of liability apply equally in favor of the legal representatives, employees, and vicarious agents of AGT, insofar as claims are asserted directly against them.
12.7 Mandatory statutory liability provisions, in particular strict liability under § 7 of the German Road Traffic Act (StVG), the liability exclusion under § 8a StVG for paid passenger transport, as well as the liability provisions under § 23 of the Passenger Transportation Act (PBefG) and § 7 of the Liability Act (HaftPflG), remain unaffected by the above provisions.
§ 13 Contractual Obligations and Notices
13.1 AGT Bus- & Eventlogistik GmbH is entitled to unilaterally set, at its reasonable discretion, requirements for the carriage of travel luggage (hand luggage and suitcases, bags, bulky luggage, bicycles, skis, etc.). Customers are obliged to comply with these requirements.
13.2 AGT Bus- & Eventlogistik GmbH assumes no responsibility or liability for items left behind by the customer or their passengers in the passenger compartment, unless the loss or damage results from an intentional or grossly negligent breach of duty by AGT Bus- & Eventlogistik GmbH, its legal representatives, or vicarious agents.
13.3 Supervision of luggage during loading and unloading is not the responsibility of AGT Bus- & Eventlogistik GmbH.
13.4 There is no entitlement to the transport of animals. The transport of animals must be reported to AGT Bus- & Eventlogistik GmbH before conclusion of the contract. If written approval is granted by AGT Bus- & Eventlogistik GmbH, the animals may not be placed on seats and must be carried in suitable transport containers.
13.5 The customer is responsible for the behavior of their passengers during transport. If the customer or their passengers fail to follow the instructions of the bus drivers, they may be excluded from further transport if continuing to transport them becomes unreasonable for AGT Bus- & Eventlogistik GmbH or its vicarious agents. In such cases, there is no entitlement to a refund.
13.6 The customer is liable for damage caused to the vehicle, unless the customer is not responsible for the damage. Other claims remain unaffected.
§ 14 Passport, Visa, and Health Regulations
14.1 The customer is responsible for independently informing themselves about the passport and visa requirements as well as health regulations (e.g., vaccinations) applicable to the respective destination.
14.2 A passenger who does not have complete and proper documents at the start of or during transport may be excluded from transport.
14.3 All disadvantages, in particular the payment of withdrawal costs, arising from non-compliance with the regulations under clauses 14.1 to 14.2, are borne by the customer.
14.4 If the performance of transport is prevented or hindered for reasons attributable to improper documents under clauses 14.1 to 14.3, e.g., due to the failure of the relevant diplomatic mission to issue and deliver necessary visas in time, AGT Bus- & Eventlogistik GmbH assumes no liability, unless AGT Bus- & Eventlogistik GmbH is responsible for the prevention or hindrance.
§ 15 Assignment
Contractual claims of the customer against AGT Bus- & Eventlogistik GmbH may be assigned insofar as they relate to monetary payment. Otherwise, assignment of claims is only permitted with the prior written consent of AGT Bus- & Eventlogistik GmbH.
§ 16 Data Protection
The personal data you provide to us will be processed and used electronically insofar as it is necessary for the performance of the contract. All your personal data is processed in accordance with German and European data protection law. Further information on how your data is handled can be found in our Privacy Policy at: Privacy Policy.
16.1 If the customer has questions about data protection, they may contact info@agtlogistik.de.
§ 17 Final Provisions
17.1 No oral side agreements have been made.
17.2 Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining contract. The invalid provision shall be deemed replaced by a valid provision that comes closest to the economic purpose of the invalid provision. The same applies in the event of a gap in the contract.
17.3 For all disputes arising from or in connection with the transport contract, Hamburg is agreed as the place of jurisdiction, insofar as legally permissible.
