General Terms and Conditions

Our General Terms and Conditions apply in connection with all services offered by AGT Bus- & Eventlogistik GmbH in the field of mobility. (Booking of transportation services, concept creation, event logistics, etc.).

1st booking (passenger transportation / transfer services)

1. 1 The booking is also made by the booker for all fellow travelers included in the booking, for whose contractual obligations the booker is responsible as for his own obligations. The minimum age for participation in the transportation is 16 years if not accompanied by a parent or legal guardian. For passengers who have not yet reached the age of 18 at the start of the journey and who are traveling unaccompanied by an adult, a written declaration of consent from their legal guardian is required. The supervision of passengers, in particular children, young people and persons in need of assistance, is not part of the services provided by AGT Bus- & Eventlogistik GmbH.
If the order confirmation from the bus company deviates from the content of your registration, AGT Bus- & Eventlogistik GmbH has made a new offer, which you can accept within the given period by express or conclusive declaration (payment of the remuneration owed), provided that the necessary capacities are available at the time of acceptance.

1.2 Offers made by AGT Bus- & Eventlogistik GmbH are subject to change and non-binding, unless otherwise agreed in writing. A transportation contract is only concluded with the final booking confirmation/invoice from AGT Bus- & Eventlogistik GmbH.

2. payment of the travel price, responsibility of the customer

2.1 A deposit of 25% of the total price must be paid immediately after conclusion of the contract; the minimum amount of a deposit is EUR 150 incl. VAT. The remaining amount is due 28 days before the start of the trip. The total price is the sum of the deposit and the remaining amount.

2. 2 For bookings made less than 8 weeks before the start of the journey, the total price must be paid 28 days before the start of the journey. For bookings made at short notice within 28 days, the total price is due immediately.

2. 3 For payments by credit card, additional processing fees will be charged to the customer.

2.4 If you do not pay the travel price on time, reminder fees may be charged to you. In the event of non-payment of the travel price before departure despite a reminder with a deadline, the transportation contract will be cancelled with costs.

2.5 Cleaning costs are included in the prices quoted. Costs for the cleaning of excessively soiled vehicles and the repair of damage caused by the customer shall be borne separately.

3. trip cancellation, service and price changes

3. 1 If the transportation is made considerably more difficult, endangered or impaired as a result of force majeure that was not foreseeable when the contract was concluded, both the booker and AGT Bus- & Eventlogistik GmbH may terminate the contract. The legal consequences result from the law.

3.2 AGT Bus- & Eventlogistik GmbH is entitled to change the agreed content of the transportation contract only for legally permissible reasons. Changes or deviations of individual transportation services from the agreed content of the transportation contract, which are necessary after conclusion of the contract and which are not brought about by AGT Bus- & Eventlogistik GmbH, are only permitted insofar as these changes and deviations are not significant and do not affect the overall nature of the booked transportation.

3.3 AGT Bus- & Eventlogistik GmbH is obligated to inform the customer of a permissible cancellation of transportation or a significant change to an essential transportation service immediately after becoming aware of it.

3.4 Price changes are possible after conclusion of the transportation contract in the event of an increase in transportation costs or charges for certain services, to the extent that the increase in transportation costs or charges for certain services affects the transportation price per person or seat, if there are more than 4 months between receipt of the booking confirmation/invoice and the agreed start of transportation. Should this be the case, the customer will be informed immediately, but no later than 21 days prior to transportation. Price increases thereafter are not permitted. In the event of a price increase of more than 5% of the agreed total price or in the event of a significant change to an essential transportation service, the customer may withdraw from the contract. The customer is obliged to assert these rights against AGT Bus- & Eventlogistik GmbH immediately upon receipt of the notification of change. For this purpose, the written form by e-mail or letter is specified.

3.5 The Booker must notify the Company of so-called high-risk journeys before the contract is concluded. These are, in particular, high-risk journeys for the transportation of soccer fans, politically motivated demonstrators or similar events. In the case of so-called high-risk journeys, AGT Bus- & Eventlogistik GmbH is entitled to demand a deposit from the booker. The amount of the deposit will be decided on a case-by-case basis according to the size of the bus in question and will amount to at least € 1,500.00.

4 Changes, rebookings and withdrawal by the customer

4.1 You can withdraw at any time before the start of transportation. For reasons of proof, we recommend that you declare your withdrawal in writing by e-mail or letter.

4.2 After a booking has been made, "one" change to the booking can be made without a processing fee. Further changes are subject to a processing fee of €28.00 per transaction. For reasons of proof, it is strongly recommended that any desired changes to the contract be submitted in writing by e-mail or letter. If this results in a change to the service, additional costs may arise, the amount of which depends on the circumstances of the individual case and which are to be borne by the customer. These will be communicated to the customer in writing after intensive examination by AGT Bus- & Eventlogistik GmbH. The change can only be implemented once the customer has also confirmed the rebooking, including the additional costs, in writing.

4. 3 If the customer wishes to change the date after the booking has been made, AGT Bus- & Eventlogistik GmbH must be notified of this in writing. In the event of a rebooking, the general cancellation conditions apply to the old date (see 4.4). However, these may vary or be waived after individual examination. Additional costs may be incurred with regard to the new date, which shall be borne by the customer. AGT Bus- & Eventlogistik GmbH will inform the customer of these in writing after intensive examination. The rebooking can only be implemented if the customer confirms the rebooking, including the additional costs, in writing by e-mail or letter.

4.4 In the event of withdrawal, AGT Bus- & Eventlogistik GmbH may demand lump-sum compensation calculated according to the following percentages of the agreed total price. You are free to prove that no or less damage has been incurred. Cancellation costs at a glance:

5. liability

5.1 The liability of AGT Bus- & Eventlogistik GmbH shall be governed by the statutory provisions.

5.2 The contractual liability of AGT Bus- & Eventlogistik GmbH applies to damages that are not physical injuries and this is limited to twice the transportation price, as soon as a damage was caused neither intentionally nor through gross negligence or is based solely on the fact that a service provider used by AGT Bus- & Eventlogistik GmbH is solely responsible for the damage incurred. Liability-limiting or liability-excluding statutory provisions based on international agreements to which a service provider used by AGT Bus- & Eventlogistik GmbH may refer shall also apply in favor of AGT Bus- & Eventlogistik GmbH.

5. 3 For claims for damages that are not physical injury and are not based on intent or gross negligence on the part of AGT Bus- & Eventlogistik GmbH, a limitation of liability to EUR 1,000.00 per claimant and transportation is agreed. Liability in accordance with §23 of the Passenger Transportation Act remains unaffected.

6 Contractual obligations and information

6.1 If the transportation is not provided in accordance with the contract, you only have the statutory warranty rights of remedy, reduction of the transportation price, termination of the contract and compensation for damages if you did not culpably fail to notify AGT Bus- & Eventlogistik GmbH of a defect that occurred during the transportation.

6.2 In the event of a defect, you may only remedy the defect yourself or, in the event of a significant defect, terminate the transportation if you grant a reasonable period of time to remedy the defect. A deadline is not required if the remedy is impossible, is refused by AGT Bus- & Eventlogistik GmbH or cannot be provided within a reasonable period of time.

6. 3 Our office team, which is available at all times, will accept a notification of defects; you will receive the relevant emergency numbers before the start of transportation. You will then receive confirmation of receipt of the notification of defects in writing by e-mail or SMS/Whats App.

6.4 The place of jurisdiction for all disputes shall be the registered office of the head office in Hamburg (insofar as an agreement on the place of jurisdiction is legally permissible).

6.5 Claims arising from the contract of carriage can only be asserted by the passenger himself. An assignment of these claims is not permitted.

6. 6 Contractual claims expire one year after the contractually agreed end of the transportation, but not before AGT Bus- & Eventlogistik GmbH has been notified of a defect, and not in the case of intent. The limitation period shall be suspended for as long as negotiations are being conducted between AGT Bus- & Eventlogistik GmbH and you regarding a claim or the circumstances giving rise to the claim. The suspension ends if one party refuses to continue negotiations. The statutory limitation periods shall apply to claims in tort.

6.7 All offers and the prices included are exclusive of road tolls, tolls, parking fees and any accommodation costs for the driver in the case of multi-day trips, unless otherwise stated in the order confirmation.

6.8 Please observe the upper limit of one piece of luggage (max. 23 kg) and one small piece of hand luggage (small handbag or rucksack, no travel trolley or similar) per person. Bulky luggage (sports equipment, tools, tents or similar, as well as oversized luggage, will only be transported with the prior agreement and approval of AGT Bus- & Eventlogistik GmbH. We would like to point out that AGT Bus- & Eventlogistik GmbH is not responsible for the supervision of items left behind by the booker or his passengers in the passenger compartment of the vehicle, nor does it accept any liability for them. The supervision of luggage during loading and unloading is also not the responsibility or liability of AGT Bus-& Eventlogistik GmbH.

6.9 Only contractual partners (bus companies) that have all the necessary concessions for transportation and employ qualified personnel shall be used.

6. 10 There is no entitlement to the transportation of animals. The transportation of animals must be notified to AGT Bus- & Eventlogistik GmbH before the contract of carriage is concluded. If written permission has been granted by AGT Bus- & Eventlogistik GmbH, the animals may not be accommodated on seats and must be carried in suitable transport containers.

6. 11 The booker is responsible for the conduct of his passengers during transportation. If the booker or his passengers do not follow the instructions of the bus driver, they may be excluded from further transportation if this makes further transportation unreasonable for AGT Bus-& Eventlogistik GmbH or its service provider. In such cases, there is no entitlement to a refund. The booker is liable for damage to the vehicle caused by himself or his passengers.
Exception: Neither the customer nor his passengers are responsible for the damage. Other claims remain unaffected.

7. passport, visa and health regulations

7.1 Please inform yourself about the passport and visa regulations and health formalities (vaccinations) applicable to the respective country of travel. AGT Bus- & Eventlogistik GmbH accepts no liability should the transportation be prevented or hindered for reasons attributable to improper travel documents.

7.2 A passenger who does not have complete and correct travel documents at the start of transportation or during transportation may be excluded from transportation. Expenses will not be reimbursed.

8.2 With the conclusion of the contract or booking, the booker agrees to the use of his data for the processing of the booked bus trip. This includes address and contact data for processing the transaction.

8.3 No personal data will be passed on to external tourism service providers, coach companies or event organizers.

8.4 If you have any questions or wish to exercise your rights (e.g. deletion of data), please write to info@agtlogistik.de.

Report misconduct

As soon as you become aware of incidents or business practices of AGT Bus- & Eventlogistik GmbH where you have doubts as to whether they are in accordance with the legal regulations, the Code of Conduct or other guidelines of AGT Bus- & Eventlogistik GmbH, you can report them now.

Not only the support of employees, but also the assistance of customers and business partners is of great importance. This is the only way to react immediately and avert or minimize damage. Ideally, the problem should be discussed directly and confidentially with a contact person at AGT Bus- & Eventlogistik GmbH. In this way, a solution can be found quickly and without detours.

However, there may be situations in which this direct route does not appear feasible. In such cases, a specialized legal ombudsman (lawyer of trust) has been set up as an internal and external reporting office at AGT Bus- & Eventlogistik GmbH. The information will be received confidentially. The reporting person can communicate openly with the ombudsman, stating their name and contact details. This makes it possible to ask questions about the facts of the case, which sometimes proves to be very helpful. If desired, however, the identity of the person making the report will not be disclosed.

If you do not wish to disclose your identity to the lawyer of confidence, you can submit information online and anonymously via the following whistleblower portal. Anonymous tips will also be investigated.

It is trusted that no information will be submitted with dishonest intent. False reports can have legal consequences. With the help of this reporting system, AGT Bus- & Eventlogistik GmbH ensures that every report is carefully checked and that the reporter does not suffer any disadvantages as a result.
